1. Scope of Application
These Terms and Conditions (hereinafter "T&Cs") govern the sale of digital images, printed photos, and photo products offered by NBates Photography through our online shop hosted on GotPhoto (https://nbatesphotography.gotphoto.com). By placing an order through our online store, the customer agrees to these T&Cs.

2. Offer and Conclusion of Contract
All products and services presented in the online shop are non-binding and subject to change. By completing the order process, the customer submits a binding offer to purchase the selected products. The purchase contract is concluded when the customer receives an order confirmation via email.

3. Prices and Payment
All prices listed in the online shop are in USD and include applicable taxes. Shipping costs (if applicable) will be shown separately during checkout. Payments can be made via the payment methods offered during the checkout process. Orders will only be processed after full payment is received.

4. Delivery
Digital downloads will be made available immediately after payment confirmation. Physical photo products will be produced and shipped according to the delivery times stated in the order confirmation. Delivery times are estimates, and delays may occur due to unforeseen circumstances.

5. Rights of Use
All images and products purchased are for personal, non-commercial use only. All copyrights and image rights remain with NBates Photography. Any reproduction, distribution, or commercial use without explicit written consent is prohibited.

6. Return Policy & Refunds
Due to the personalized nature of photo products, returns or exchanges are not possible unless the delivered product is defective or damaged. In such cases, the customer must notify us within 7 days of receiving the product, including photo proof of the defect. We will arrange for a replacement or refund at our discretion.

7. Data Privacy
Customer data is collected, processed, and stored solely for the purpose of processing the order and fulfilling the contract, in accordance with applicable data protection laws. For full details, please refer to GotPhoto's Privacy Policy.

8. Liability
NBates Photography is not liable for slight negligence, provided that no essential contractual obligations are affected. Our liability for damages is limited to foreseeable damages typical for this type of contract.

9. Final Provisions
These Terms & Conditions are governed by the laws of the State of Florida, USA. If individual provisions of these T&Cs are invalid, the validity of the remaining provisions remains unaffected.
